  1. Purpose of the processing

The processing of your personal data aims to:

(a) fulfill existing contractual relationships involving you or your company, thus fulfilling all related obligations, both civil, tax, and accounting, as well as insurance, and any related and consequential obligations.

(b) manage administrative, tax, and accounting obligations of the company resulting from existing contractual relationships that involve you.

(c) establish relationships aimed at the development and finalization of new contractual relationships.

(d) ensure the protection of rights and/or interests of the company in administrative and/or judicial proceedings, where your involvement becomes necessary.

Some of the personal data concerning you may reveal your racial or ethnic origin. The processing of such data is legitimized by your explicit consent (Art. 6, FDPA of September 20, 2020).

  1. Legal basis of the processing

The legal basis legitimizing the processing of your data is represented by:

(a) the execution of the employment contract in which you or your company are/will be a part (Art. 6, FDPA of September 20, 2020). (b) compliance with legal obligations to which the company is subject (Art. 6, FDPA of September 20, 2020). (c) the pursuit of a legitimate interest of the company (Art. 6, FDPA of September 20, 2020).

  1. Recipients of personal data

Recipients of your personal data will be:

  1. employees and collaborators of the Company b. clients, suppliers, and collaborators of the Company c. external accounting and tax consulting firms d. banks and insurance institutions e. judicial authorities and other competent public authorities

Some of the recipients listed above may receive data outside the Swiss territory, in states where the Federal Council has previously recognized the existence of data protection systems.

  1. Data retention period

Your data will be stored for the entire duration of the existing contractual relationship with you or your company and for the entire period following its termination until they are no longer necessary for compliance with legal or contractual obligations and are no longer necessary for any purposes related to the protection of the company before any judicial and/or administrative authority. Therefore, your data will be deleted when every possible need for protection as indicated above, for which your data may be necessary, is extinguished, including the prescription of the rights connected to such protection.

  1. Automated decision-making processes

The data concerning you are not processed with automated decision-making processes.

  1. Rights of the data subject

With regard to personal data concerning you, you have the right to exercise the following rights:

(a) Right to access personal data

You have the right to obtain from the data controller confirmation as to whether or not your data is being processed and, if so, the right to access it. You have the right to obtain from the data controller the rectification of inaccurate data concerning you. You also have the right to obtain the integration of your incomplete data, taking into account the purposes of their processing.

(b) Right to erasure of personal data

You have the right to obtain from the data controller the erasure of your data, provided that they are no longer necessary for the purposes for which they were collected or otherwise processed, or that they are processed unlawfully, or their erasure constitutes compliance with a legal obligation provided by the law of the Swiss Confederation. You have the right to object at any time, for reasons related to your particular situation, to the processing of data concerning you when their processing is necessary for the pursuit of a legitimate interest of the data controller. This right ceases if the data controller concerning you demonstrates the existence of compelling legitimate reasons for processing that override your interests, rights, and freedoms, as well as for the establishment, exercise, or defense of a right in a judicial proceeding.

(c) Right to receive data or request transmission to third parties

You have the right to receive from the data controller, or obtain from the data controller the transmission to another data controller, the personal data concerning you that you have provided and whose processing is carried out in an automated manner, provided that this does not affect the rights and freedoms of others.

(d) Right to lodge a complaint

If you believe that the processing concerning you violates the FDPA of September 25, 2020, you have the right to lodge a complaint with the competent supervisory authority.
